I am so excited to offer this course! I have been mentoring photographers and have found a lot of confusion in the land of pricing and IPS - so here is your chance to get official instruction, and pick my brain for an afternoon!

This is an introductory workshop - meaning it is the first time I have offered it in this format. Which means you get a special deal, the price won't be this low again. :)

By purchasing a ticket, you are agreeing to the terms below.

 

Workshop Terms and Conditions

This is a legally binding contract between Brooke Summer Photography, LLC (hereafter referred to as “Instructor(s)”) and the ticket purchaser (hereafter referred to as “Participant(s).”)

 

1. Pricing and Payment Policy

To attend the workshop and to reserve a photographer spot, the Participant shall pay to Instructor, upon execution of this agreement, a non-refundable reservation fee in the amount of $97.00. This fee may vary, based on early bird discounts, additional follow up, or other coupons available. The Participant understands and agrees that the ticket is non-refundable, however may be transferred to another photographer, upon approval from the Instructor. Transference and payment will be the responsibility of the Participant, and must be communicated with the Instructor in writing.

In the event that Participant is unable to attend, or does not attend the workshop, for any reason, the full amount paid shall be forfeited by Participant and paid to the Instructor as liquidated damages and not as a penalty. Both parties agree that such amount is reasonable.

 

2. Position

The Instructor agrees to deliver the participant a workshop that includes formal instruction, demonstration, and individualized attention.

 

3. Relationship

Nothing herein shall be deemed to constitute a partnership or joint venture between Instructor and Participant. Further, this workshop does not create a relationship beyond the confines of the workshop.

 

4. Equipment

The Participant is responsible for providing all of the equipment of use with which to complete the workshop unless agreed upon otherwise. The participant understands that providing their equipment could mean potential damage to the equipment, including but not limited to: dropping of cameras, lenses or other equipment; knocking equipment on venue or workshop surfaces; any other damage that may be incurred. The Participant agrees that the Instructor and workshop are not to be held liable for any damage to personal equipment, property, or persons.

 

5. Confidentiality

The Participant understands that all materials, including any printed or digital materials, and all text/images included, the workshop files and video tutorials, contracts, financial documents, agreements, spreadsheets, editing workflow, shooting advice and teachings, workshop content, text, and any conversations inside the scope of the workshop dates and other and all information or documents that are given to her/him in the scope of the assigned workshop are the exclusive property of the Instructor and are privileged and confidential information. The Participant agrees not to disclose the confidential information obtained to anyone unless required to do so by law.

The participant also agrees not to reproduce or exchange for any financial or other compensation any printed or digital materials.

 

6. Schedule

The Participant understands that the schedule is subject to change due to circumstances including but not limited to: weather, travel arrangements, and illness.

 

7. Respect of Venue and Persons

The Participant understands and agrees to treat the venue with the utmost respect, following all rules and regulations set forth by the Instructor and the chosen venue. The Participant also understands that if the Instructor has reason to believe the Participant is causing harm to any other participants, models, or the venue, the Participant will be asked to leave, and no refunds will be issued. This may include but is not limited to: physical harm to any objects within the venue, speaking to other participants or models or Instructor in a hostile manner, or physically harming or assaulting any participants or models.

 

8. Resolution

Participant shall first approach Instructor with any issues related to the workshop to reach an amicable solution.

 

9. Model Usage

Any images resulting from the workshop may ONLY be used for portfolio, marketing and collateral use (in print and online). Images may not be used for publication in print or online, with the exception of the Participant's personal photography blog.

 

10. Facebook Alumni Group

Participant is NOT purchasing a membership to the workshop Alumni Facebook Group, nor is membership included in the workshop fee or ticket. The workshop Alumni Facebook Group is NOT a guaranteed benefit or product of the workshop. If for any reason deemed appropriate by the Instructor that participant's membership should be discontinued, the Instructor may release participant from the alumni group without notice or as to why.

 

11. Required Images

In the event that the workshop involves shooting with models, participant will submit at least 3 original images of each model from the workshop within 3 weeks of the workshop. The Participant understands that model releases will not be provided until the images are submitted, and any images obtained from the workshop may not be used publicly without the model releases.

 

12. Waivers

A waiver by either party of any provision of this Agreement in any instance shall not be deemed a continuing waiver for the future.

 

13. Indemnification

The Instructor shall be held harmless for any and all injury to Participant and Participant’s equipment during the course of the workshop and the immediately surrounding events.

 

14. Choice of Law and Forum and Statute of Limitations

This agreement shall be interpreted under the laws of the State of Colorado. Any litigation under this agreement shall be resolved in the trial courts of Arapahoe County, Colorado. The parties agree that any action in relation to an alleged breach of this Agreement shall be commenced within one year of the date of the breach, without regard to the date the breach is discovered. Any action not brought within that one year time period shall be barred, without regard to any other limitations period set forth by law or statute.

 

15. Arbitration

All disputes arising under this Agreement shall be submitted to binding arbitration in Arapahoe County, Colorado, pursuant to the rules of the American Arbitration Association. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof.

 

16. Severability

If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

 

17. Collection

In the event that the Studio is required to file a legal action to collect fees due from Participant under this Agreement, or to otherwise enforce this Agreement, then the Studio shall be entitled to recover all cost and expenses incurred by the Studio relation to such legal action, including an award of reasonable attorney’s fees.

 

18. Entire Agreement

This agreement contains the entire understanding between Brooke Summer Photography LLC and the Participant. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.

By purchasing a ticket to the workshop, you are agreeing that you have read, understand and agree to all of the above contractual agreements.
